Man UpRight respects intellectual property rights and expects the same from our users. Under the U.S. Digital Millennium Copyright Act (17 U.S.C. §512), we will respond to proper notices of alleged infringement occurring on or through our Service (including Think Tank Connect).
A. Notice of claimed infringement (how to file)
If you believe content on Man UpRight infringes your copyright, send a notice to our DMCA Agent that includes all of the following:
-
Your physical or electronic signature.
-
Identification of the copyrighted work you claim is infringed (or a representative list).
-
Identification of the material you claim is infringing and where it is located on the Service (a URL or clear description).
-
Your contact information: name, address, phone, and email.
-
A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
-
A statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act for the owner.
We may share your notice (including your contact info) with the user who posted the content and third parties as required to process your claim.
B. What we do when we receive a proper notice
-
We may remove or disable access to the allegedly infringing content.
-
We may notify the user and, if appropriate, pass along your notice.
-
We enforce a repeat-infringer policy and may terminate accounts that receive multiple valid notices.
C. Counter-notification (if your content was removed)
If your content was removed and you believe it is not infringing or that you have authorization to use it, you may send a counter-notification to our DMCA Agent containing:
-
Your physical or electronic signature.
-
Identification of the material that has been removed or to which access has been disabled, and the location where the material appeared before it was removed/disabled.
-
A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
-
Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for Collin County, Texas (or if outside the U.S., to any judicial district in which Man UpRight may be found), and that you will accept service of process from the person who provided the original DMCA notice or their agent.
Upon receipt of a valid counter-notification, we may restore the material in 10–14 business days, unless the original complainant informs us that they have filed court action seeking to restrain the user from engaging in infringing activity.
D. Repeat infringers
We may disable or terminate accounts of users who are found to be repeat infringers at our discretion.
