Man UpRight — Onboarding Acknowledgments & Terms (Texas)

Man UpRight is based in Allen, Texas. These terms use Texas law and Texas venues.
Onboarding Acknowledgments (must acknowledge each)

Short Disclaimers (what Man UpRight is / isn’t)
Educational program. Habits, planning tools, and community support to help you organize and execute.
Not professional advice. No medical, mental-health, legal, tax, or investment advice.
No clinical or crisis services. If you are in crisis: 911 or 988 (U.S.).
No guarantees. Results depend on your choices and effort.
Peer community. Users are responsible for their own statements and agreements.
Health/Activity risks. Consult a professional before lifestyle changes; participate at your own risk.
Privacy. Not HIPAA-covered; see the Privacy Policy for data practices.
AI & Avatars. Some content may be AI-generated or avatar-presented; use judgment before acting.
Acceptable use. Content is for your personal use; do not copy, resell, scrape, or misuse the platform.
Texas Governing Law & Dispute Resolution
Governing Law & Venue. These terms and any dispute are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. Subject to the arbitration clause below, exclusive venue lies in state or federal courts in Collin County, Texas. You and Man UpRight consent to personal jurisdiction in those courts.
Binding Arbitration; Class-Action Waiver. Except for claims seeking injunctive relief for intellectual-property misuse or unauthorized access/abuse of the Service, any dispute, claim, or controversy between you and Man UpRight arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The seat/venue of arbitration is Collin County, Texas. The arbitrator may award any relief available in court. You and Man UpRight waive the right to a jury trial and agree arbitration will proceed only on an individual basis—no class, collective, or representative actions. If this waiver is found unenforceable as to a claim, that claim must proceed in court (not arbitration) in Collin County, Texas.
Opt-Out. You may opt out of arbitration within 30 days of first accepting these Terms by emailing support@manupright.com with your name, account email, and a clear statement that you opt out of arbitration. Opting out does not affect other provisions.
Injunctive Relief. Either party may seek temporary or preliminary injunctive relief in a Texas court to protect intellectual property or the Service’s security and integrity.
Additional Terms
Limitation of Liability. To the fullest extent permitted by Texas law, Man UpRight and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages. Our aggregate liability for any claim is limited to the greater of $100 or the amounts you paid to Man UpRight in the 12 months before the claim.
Disclaimer of Warranties. The Service is provided “AS IS” and “AS AVAILABLE.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
User Content & Conduct. You are responsible for what you post. Do not share unlawful, harassing, or misleading content; do not dox, spam, or infringe others’ rights. We may moderate or remove content, and suspend accounts that violate the Community Code or law.
Intellectual Property. Man UpRight content is licensed to you for personal use only. Do not copy, resell, publicly display, scrape, or build derivatives without written permission.
Eligibility. You must be 18+ (or age of majority in your jurisdiction) to use the Service.
Changes to Terms. If we make material changes, we will notify you and may require renewed consent.

Be respectful; no harassment or hate.
Share experiences; do not give medical, legal, tax, or investment directives.
Use clean agreements: scope, owner, deadline, check-in.
Keep private info private; no doxxing or scraping.
Report concerns via the Report link; moderators may remove content or users for safety or legal reasons.
Your Agreement
By checking all acknowledgment boxes and selecting “I Agree and Continue”, you confirm that:
You have read and agree to the Onboarding Acknowledgments, Short Disclaimers, Texas Governing Law & Dispute Resolution, Additional Terms, and Community Code above;
You are 18+ (or the age of majority in your jurisdiction); and
Your consent will be recorded with date/time, IP address, and the current Terms version.
